Objective Although patients exercise greater autonomy than in the past, and shared decision making is promoted as the preferred model for doctor-patient engagement, tensions still exist in clinical practice about the primary locus of decision-making authority for complex, scarce, and resource-intensive medical therapies: patients and their surrogates, or physicians. We assessed physicians’ attitudes toward decisional authority for adult venoarterial extracorporeal membrane oxygenation (VA-ECMO), hypothesizing they would favor a medical locus. Design, Setting, Participants A survey of resident/fellow physicians and internal medicine (...) attendings at an academic medical center, May to August 2013. Measurements We used a 24-item, internet-based survey assessing physician-respondents’ demographic characteristics, knowledge, and attitudes regarding decisional authority for adult VA-ECMO. Qualitative narratives were also collected. Main Results A total of 179 physicians completed the survey (15 percent response rate); 48 percent attendings and 52 percent residents/ fellows. Only 32 percent of the respondents indicated that a surrogate’s consent should be required to discontinue VA-ECMO; 56 percent felt that physicians should have the right to discontinue VA-ECMO over a surrogate’s objection. Those who self-reported as “knowledgeable” about VA-ECMO, compared to those who did not, more frequently replied that there should not be presumed consent for VA-ECMO (47.6 percent versus 33.3 percent, p = 0.007), that physicians should have the right to discontinue VAECMO over a surrogate’s objection (76.2 percent versus 50 percent, p = 0.02) and that, given its cost, the use of VA-ECMO should be restricted (81.0 percent versus 54.4 percent, p = 0.005). Conclusions Surveyed physicians, especially those who self-reported as knowledgeable about VA-ECMO and/or were specialists in pulmonary/ critical care, favored a medical locus of decisional authority for VA-ECMO. VA-ECMO is complex, and the data may (1) reflect physicians’ hesitance to cede authority to presumably less knowledgeable patients and surrogates, (2) stem from a stewardship of resources perspective, and/or (3) point to practical efforts to avoid futility and utility disputes. Whether these results indicate a more widespread reversion to paternalism or a more circumscribed usurping of decisional authority occasioned by VA-ECMO necessitates further study. (shrink)

The rise of neurotechnologies, especially in combination with artificial intelligence (AI)-based methods for brain data analytics, has given rise to concerns around the protection of mental privacy, mental integrity and cognitive liberty – often framed as “neurorights” in ethical, legal, and policy discussions. Several states are now looking at including neurorights into their constitutional legal frameworks, and international institutions and organizations, such as UNESCO and the Council of Europe, are taking an active interest in developing international policy and governance guidelines (...) on this issue. However, in many discussions of neurorights the philosophical assumptions, ethical frames of reference and legal interpretation are either not made explicit or conflict with each other. Dr. Hittinger's book causes us to remember how genuinely delicate and refined is the balance between reason and faith in St. Thomas' view of human knowledge and its relationship to reality. This enabled St. Thomas to develop with discernment his (...) notion of the natural law, because St. Thomas understood that an act of genuine intellection distinguished in order to unite, not separate. Therefore, there was an intrinsic unity to truth and a unity to philosophical experience which reflected reality-something which has gotten lost in the contemporary morass of interminable dialectics. Have the contemporary attempts to retrieve a notion of the natural law succeeded in maintaining this balance? If such attempts have not succeeded in maintaining the requisite balance, what are the consequences of the loss of this balance for the success of their endeavor? When in the history of philosophical experience this balance cannot be maintained, one is forced to move in one of two directions. The first is towards a kind of fideism in which the fundamental questions raised by reason are only resolvable by the faith; thus philosophy is absorbed into theology. The second is towards the claim that reason can answer all that is answerable (which may be very limited) and thus faith becomes subordinate to reason. The latter either leads to rationalism or a variety of positivism. For Rittinger what appears to be a contemporary attempt to retrieve natural law moral philosophy has proven itself unable to avoid a fideistic solution to moral philosophy; for faith in the end resolves all the fundamental issues raised in regard to moral philosophy. The beginning of the discussion of moral philosophy and man as the author of his actions was very carefully placed in the writings of St. Thomas. It is only after St. Thomas had established certain fundamental truths and principles in natural theology and the philosophy of human nature that he begins to discuss moral philosophy. St. Thomas first established the existence of a personal God, who is both the efficient and final cause of all finite being. God's being is also discovered to be identical to truth, goodness, and beauty. God is recognized as that which all men seek even though only the beatific vision will present this to the intellect and will with an all-consuming necessity. "Beings" are ordered in two ways, as parts of totality, and as things to an end. The ordering of things to an end is the most important, since the final cause is the cause of all the other causes. Therefore an identification of the final cause makes all the other causes and the 344 BOOK REVIEWS order in things intelligible. Also it is only after a great deal is known about human goods, and human nature, and the ordination of human goods that St. Thomas is ready to begin a discussion of the first principle that states the good is to be pursued or the good is to be done. St. Thomas has also established, through reason, that man by nature desires and should desire in justice to give God his due. There· fore religion properly understood is natural to man. The above pro· vided St. Thomas with the knowledge prerequisite for the development of a natural law moral philosophy. If one perceives that we are at a juncture in the history of philosophy where one no longer can develop or defend the kind of knowledge that is a prerequisite to the successful development of a natural law ethics, then this must he faced with all its consequences. Is a natural law ethics still viable? This is true even if one believes that any attempt to establish such knowledge would drag the ethician into an in· terminable debate in regard to the is-ought dilemma announced by Hume or the positivist rejection of metaphysics and the philosophy of nature. ISBN: 978-0-268-02228-0.It does not bode well for a collection of essays when the introduction needs to make a concession like the one found here: “This (...) volume brings together a plurality of approaches to a loosely related set of questions, themes, and phenomena” (6). Yet, surely, truth in advertising is an uncommon virtue. The frank honesty of Jeffrey Bloechl, the editor of this volume, is much to be commended.What unifies the essays in this volume is not a common topic or a common approach but a common concern with the problem of understanding the relation between Christianity and secular reason. The issue in play is how much respect a religion that claims to be the recipient of divine revelation owes to autonomous reasoning in any particular age. The problem is exacerbated in those periods of history that are marked by strong claims for the powers of human reasoning.Bloechl’s introduction is particularly helpful due to its distinction between secular reason and secularized reason. Unless a believer takes the fideist position of holding that only claims grounded in faith are valid knowledge-claims, there is no reason to deny or cast skeptical aspersions on secular reason. The term simply names the use of reason according to its proper governing principles on any topic where the justifications for various truth-claims are drawn only from this-worldly experience and, for disciplinary reasons, make no use of divine revelation. It is the type of reasoning that is done within a saeculum, that is, within a given period of time, according to the canons of sound reasoning operative in that epoch. The term “secularized reason,” by contrast, names the view of reason that is hostile to the legitimacy of any knowledge-claim that involves the testimony of divine self-disclosure as its warrant. The proponents of secularized reason often conveniently overlook the likelihood that such hostility risks begging the question by disallowing any form of divinely backed testimony in principle, while allowing human testimony in such spheres as history or courts or law. If one is prepared in general to accept testimony as a justification for a truth-claim, then the proper criterion is the credibility of the source. But then there is no principled way to preclude in advance the possibility that testimony that originates with God might provide the strongest possible type of warrant for certain knowledge-claims. It is mere prejudice to decide in advance that this alternative is simply beyond the pale of consideration.Threaded through the essays in this volume is the perennial problem of the relationship of faith and reason. Earlier ages posed the problem on their own terms, sometimes quite different from modern assumptions. Readers unfamiliar with the thought of Thomas Aquinas, for instance, might well be [End Page 141] surprised to learn that the very first question of the Summa theologiae asks whether any sort of sacra doctrina is necessary beyond the philosophical sciences. Such a stance does not raise a question about whether faith can be a genuine source of knowledge, but merely asks if there is need for the sort of knowledge that is grounded in faith. Aquinas answers the question not only by reflecting on the difficulties that arise from expecting that everyone will have the necessary time, interest, and intellectual resources to figure out for themselves the things that they need to know for the sake of salvation; he also notes certain areas that are entirely beyond the scope of unaided reason, such as knowledge about the triune nature of God.By contrast, the proponents of secularized reason tend to cast doubt on the very possibility that any truth-claim based on religious faith could even be counted as knowledge. Peter Abelard (1079–1142 ce) was the most wide‐ranging philosopher of the twelfth century. He quickly established himself as a leading teacher of logic in and near Paris shortly after 1100. After his affair with Heloise, and his subsequent castration, Abelard became a monk, but he returned to teaching in the Paris schools until 1140, when his work was condemned by a Church Council at Sens. His logical writings were based around discussion of the “Old Logic”: Porphyry's Isagoge, aristotle'S Categories and (...) On Interpretation and boethius'S textbook on topical inference. They comprise a freestanding Dialectica (“Logic”; probably c.1116), a set of commentaries (known as the Logica [Ingredientibus], c. 1119) and a later (c. 1125) commentary on the Isagoge (Logica Nostrorum Petititoni Sociorum or Glossulae). In a work Abelard called his Theologia, issued in three main versions (between 1120 and c.1134), he attempted a logical analysis of trinitarian relations and explored the philosophical problems surrounding God's claims to omnipotence and omniscience. The Collationes (“Debates,” also known as “Dialogue between a Christian, a Philosopher and a Jew”; probably c.1130) present a rational investigation into the nature of the highest good, in which the Christian and the Philosopher (who seems to be modeled on a philosopher of pagan antiquity) are remarkably in agreement. This 30th volume of Antonio Piolanti's Studi Tomis-tici contains the papers given at the fourth Rolduc Symposium (1986) on the thought of St. Thomas Aquinas. Five of the papers are in French, and seven (...) in German. The other eight, plus a "Preface" (pp. 7-11) with a brief summary of each of the papers, are in English. There is no point in duplicating the summaries. Still less is there possibility of giving an appropriate critique of each of the articles in a short review, since in justice each would have to be assessed against the individual writer's own background and in accord with his special intents. The most that can be done is to touch on some general issues brought to foe fore in the volume. Of notable interest is Roberto Busa's paper on the methods and use of his Index Thomistieus. By direct investigation Busa (p. 36) finds that the ·combination lex et libertas is nowhere used in St. Thomas, and that its import is not indicated anywhere by the relevant conjunctions and prepositions in the Concordantia altera. Rather than being opposed notions "libertas est ecx: amore legis" (p. 36). Busa also notes "that in the works of Aquinas not a single instance of conscientia dubia or conscientia incerta occurs" (p. 133, n. 31). Jude P. Dougherty's "Aquinas on Punishment" (pp. 160-170) is a timely and solid article on that issue in.today's social circumstances. In regard to the death penalty the article concludes: " Given the views of Aquinas on punishment, it would be difficult to argue that Catholic social thought requires an abolitionist mindset " (p. 169). In this respecl Aquinas " remains unchallenged by the data uncovered by contemporary empirical study" (p. 170). Richly informative Scriptural and theological studies by J. P. M. van der Ploeg (pp. 185-199) and Johannes Stohr (pp. 219-241) deal with the Old Law and Aquinas's treatment of it. Four shorter articles (pp. 243-280) discuss Aquinas's moral doctrine in relation to the N.ew Law. The rest of the papers are in the more professedly ethical realm, on sensitive topics of concern today in the field of Catholic morality. They maintain the currently accepted level of discussion for philosophical wo.rk in that area. A masterly article by S. Pinckaers (pp. 15-24) locates the background against which these discussions hav.e been articulated. In that setting "liberty" and "law" were projected as though they stood in sharp contrast to each other. The basic problem then lay in the struggle 539 540 BOOK REVIEWS to uphold on the one hand individual rights against encroachment on the part of law, and on the other hand to safeguard law against erosion by individual claims. Pinckaers shows how drastically this attitude is opposed to the mentality of Aquinas, for whom the liberty at stake may be called "quality liberty" (liberte de qiialite-p. 19), as contrasted with " liberty of indifference." In consequence no opposition of law to liberty is felt in Aquinas, but rather a tension that evokes continual progress in moral life. Possibility to sin has accordingly no essential place in liberty, for liberty is found in its fullness in God (p. 23). The two profoundly different moral structures, namely that of St. Thomas and that of modern moralities of obligation, have their roots respectively in these two opposed conceptions of libe11ty, the " quality liberty" of the virtues and the nominalistic "liberty of indifference" (pp. 23-24). But despite this clear delination of the problem by Pinckaers the other papers remain far from achieving a breakthrough in regard to the conception of freedom. The book concludes (p. 317) that the philosophical theology of Aquinas is a coherent whole, based upon everyday experience yet for that very reason on principles that are metaphysically evident and ad· mitted by "common sense" (see also pp. 15, 200). The treatment is neatly addressed to the problems that have been under lively discussion during the past few decades, such as the " death of God." These are dealt with against an extensive and admirably detailed historical background stretching from the Greeks to the present day, with wide coverage of secondary literature, thoroughly justifying the book's designation of itself as a study pursued "in historical perspective." However, the advisability of the Summa's order of treatment for a work meant to explain the metaphysical thinking of Aquinas is open to question. Elders (p. 8, n. 3; p. 13, n. 4) is acquainted with the vigor· 338 BOOK REVIEWS ous protests of Gilson and Pegis against reading as philosophy what Aquinas wrote as theology. Yet Elders (p. 8) allows the stand that on the ground of its intrinsic rationality Aquinas would have adhered to the Summa's order even if he had been writing a purely philosophical theology. In the present case, one may strongly object, the result is a way of thinking that dulls sensitivity to the core position of existence in Aquinas' metaphysical thought. The long and checkered history of the notion " common sense " in western philosophy should be enough to dissociate that concept from Thomistic metaphysics, and here the appeal to " everyday experience " as a support calls first for careful analysis of the radically different ways in which existence and nature are originally attained by human cognition. The book finds (p. 101, n. 61), for instance, that in the demonstration of God's existence from motion Aquinas is employing without radical distinction the same principles as Aristotle but is applying them more strictly. The pro· foundly distinctive character of Aquinas' metaphysical acumen is thereby missed. This may be aptly illustrated by one example. The pointed assertion of the Summa contra gentiles (1.9.Inter) that without consideration of the proof for God's existence " omnis consideratio de rebus divinis necessario tollitur," is understood by Elders to mean "... ist jede philosophische Betrachtung des Seienden letztlich grundlos" (p. 89). Yet granting without hesitation that the proof of the divine existence is necessary for understanding metaphysically " that which exists " (das Seiende), one may, against Elders, take the statement of Aquinas at its face value as much more finely pointed.
